Unlawful carnal intercourse and competence verdicts

If the evidence on a charge of unlawful carnal intercourse does not prove the original offence, but instead proves:

  • indecent assault
  • common assault
  • the offence of committing an immoral or indecent act with another person
  • encouraging a person to commit an immoral or indecent act

the accused may be found guilty of such an offence.
